汶萊新刑法為何引發國際公憤？納入肉刑與石刑，連滿 7 歲的兒童都可鞭笞?

汶萊政府新通過的伊斯蘭教刑法典嚴重威脅基本人權，尤其是該國最弱勢群體──這部刑法典已於 2019 年 4 月 3 日生效實施，對婚外性行為、肛交和人工流產得處死刑；竊盗者砍斷雙腕；女同性戀行為鞭苔 40 下。達青春期的未成年人犯以上罪行者，可判處與成人同樣刑罰；某些更小的兒童亦可判處鞭刑。

「汶萊的新刑法典本質上相當野蠻，連一些根本不應入罪的行為，都可處以落伍的肉刑，」亞洲區副主任費爾．羅柏森（Phil Robertson）說。「哈山納蘇丹應立即暫緩實施斷手、石刑以及所有其他侵犯人權的法條與刑罰。」

哈山納波嘉蘇丹原本在 2013 年 10 月，即正式下令頒佈這部伊斯蘭教刑法典；當時，政府表示該法將分三階段實施：第一階段將在 2014 Human Rights Watch 年制定包括罰金刑和自由刑的條款；其後兩年為第二、第三階段，將陸續實施包括斷手、鞭苔或以石塊砸死等刑罰的條款。由於這種殘忍刑罰引起國際嘩然，汶萊政府一度決定暫緩實施新法。然而，2018 年 12 月 29 日，汶萊總檢察長悄悄發佈通知，將該法全面實施的日期定於今年 4 月 3 日。

3 月 30 日，為降低新法引發的全球公憤，總理府發出聲明表示，該法典旨在「尊重與保障所有人的正當權利。」但把這部嚴酷法律形容為尊重人權的說法實在站不住腳。汶萊應立即收回實施 2013 年伊斯蘭教刑法典的命令，並按國際人權標準修正該法條文。

「汶萊刑法實施的每一天都是對人性尊嚴的多方面攻擊，」羅柏森說。「世界各國政府應讓汶萊蘇丹明白，只要鞭刑、石刑或斷肢刑繼續存在，一切就不能如常。」

與國際人權背道而馳、違反言論自由

伊斯蘭教刑法典的條文，違反汶萊在國際人權法之下的義務，包括生命權、不受酷刑及其他不當待遇的自由、言論自由、宗教自由、隱私權和個人自主權等等。該法典本質上具有歧視性，違反女性、兒童和女同性戀、男同性戀、雙性戀和跨性別人士乃至其他群體的諸多權利。

這部新法典所規定的多種刑罰，違反禁止酷刑和其他不當待遇的習慣國際法，此一原則體現在《世界人權宣言》以及《兒童權利公約》等多項汶萊已締結的條約。砸石處決和斷肢等刑罰均違反國際法上絕對禁止一切形式酷刑和其他殘忍、不人道或有辱人格的待遇及處罰的原則。

聯合國人權事務委員會在其第 36 號一般性意見中指出，「無論任何情況均不得以死刑制裁（受國際法保障的）行為」，包括通姦和同性戀。對這些「犯罪」維持死刑條文，是一種任意剝奪生命、違背汶萊國際法律義務的做法。

該法還對某些形式的搶劫和強姦以及侮辱或誹謗先知穆罕默德（第 63、76、220 條）科以死刑，不論行為人是否穆斯林。這種規定不符合死刑只限施用於「最嚴重罪行」──即涉及故意殺人之罪行──的國際原則。

這部新的伊斯蘭教刑法典，明文禁止印刷、傳播、進口、廣播和散發反對伊斯蘭信仰的出版物（第 213、214 和 215 條），不分行為人是否為穆斯林；這對言論和宗教自由權構成過度且不成比例的限制。

該法典還懲罰「不雅」穿著和跨性別變裝（第 197、198 條），任意限制言論、結社自由及隱私權，構成一種對性別表現的歧視。

傷害女性、LGBT 人士和兒童

伊斯蘭教刑法典為穆斯林婦女擺脫家庭暴力、尋求平等就業機會設置了嚴重障礙。依據該法，任何人防止合法結婚的穆斯林夫婦同居或「誘拐」已婚穆斯林婦女離開其夫妻住所均為犯罪，同時也懲罰擅自離開父母或監護人監管的行為。該法也懲罰穆斯林婦女的婚外懷孕（第 94 條）。但是，2018 年 12 月 29 日，司法部命令將第 94 條排除於 4 月 3 日立即實施的範圍之外。

該法典使同性間的合意性行為成為非法，可處死刑或鞭刑。對女同性戀、男同性戀和雙性戀者的最嚴重歧視將因此制度化。在許多國家將同性間合意性行為合法化的時候，汶萊卻和僅存的 7個仍用死刑懲罰同性合意性行為的國家站到一起。該法典還禁止穿著不同性別的裝扮，企圖以法律否定跨性別人士的存在。

這部刑法典規定「已達青春期的未成年人」（該法稱為 baligh）應負刑事責任並得處以包括石刑、鞭刑和徒刑在內的刑罰。年齡足以辦別是非的未成年人，該法稱為 mumaiyiz，按傳統伊斯蘭教法解釋大約為 7 歲左右，可處以包括鞭苔在內的刑罰。這些規定均違反國際法，包括受到《兒童權利公約》保護的兒童權利，特別是禁止死刑、酷刑和其他不當待遇。該刑法典還規定，任何使未成年穆斯林接觸伊斯蘭教以外宗教信仰和活動的行為均屬犯罪。

非穆斯林也適用

在某些據稱源於《古蘭經》的法律體系中，伊斯蘭教法只能適用於穆斯林。但在汶萊這部伊斯蘭教刑法典當中，大部分條款都不只適用於穆斯林。例如懲罰同性之間肛交行為（liwat）的第 82 條和第 84 條，就同時適用於穆斯林和非穆斯林。懲罰婚外性行為（zina）的第 69 條，懲罰女性之間性關係（musahaqah）的第 92 條，也都可以適用於被告雙方均為穆斯林或分屬穆斯林和非穆斯林的情況。

非穆斯林觸犯該法第 196 條私下共同生活、同居或親密交往（khalwat）罪行者，可處以徒刑及併科罰金。

任何人在齋戒月期間日落之前公開飲食、吸煙，可依該法第 195 條規定處以徒刑及併科罰金。

廢鋼纜變藝術品 康木祥打造台灣如意

（中央社記者唐佩君台北11日電）101廢棄鋼纜變成台灣國民外交作品。木雕大師康木祥打造的「台灣如意」，近日將正式成為德國公共藝術品，讓全世界將看到台灣。

外交部常務次長史亞平今天上午主持「捐贈德國卡斯魯爾市建城三百年之康木祥大師鋼雕作品」行前記者會，包括康木祥及德國在台協會處長歐博哲及台北101大樓事業處總經理蔡清徽等人出席。

史亞平表示，為慶祝德國卡斯魯爾市建城300年，康木祥使用台北101大樓的廢棄電梯鋼纜無償進行創作，以「如意」形象，打造出帶有東方禪味的藝術作品做為捐贈給卡市建城300年的生日禮物。

她指出，這項作品名為「台灣如意」，不僅賦予廢棄鋼纜新生命，也利用廢棄鋼纜與尊重生命、重視環保與資源再生的德國人，搭建起友誼的橋樑，也代表台灣人民對德國的祝福，展現台德雙方透過文化交流及資源再利用提升實質關係。

康木祥是國內知名木雕大師，但他這次挑戰自我，使用101大樓廢棄鋼纜創作。他在記者會上表示1年前接受史亞平邀請創作後構思，花了1年時間構思與創作，投入近半年時間清除油污又要焊接，幾乎每天都與眼藥水為伴，大家都說他瘋了，「但是生命有限，藝術生命無限。」

康木祥說這項作品為呼應卡斯魯爾市建城300年，因此他打造出高300分、重3000公斤的「台灣如意」，在創作過程中他體會到以柔克剛，人要像鋼索一樣要勇敢挑戰，要有信心，也希望用這條鋼索拉近台灣與德國的友誼。

歐博哲則說，這項作品展現了文化的深度，過去就對康木祥的作品印象深刻，因此要代表德國人民向所有參與的友人表達謝意。

德國卡爾斯魯爾市不僅是德國憲法法院所在地，同時其都市設計也以尊重自然與綠地共生聞名，加上德國重視環保與資源再生，與康木祥這件使用廢棄鋼纜的作品的精神一致，這件代表台灣國民外交的「台灣如意」8月下旬將放置在卡爾斯魯爾市的精華地段，讓世界各地造訪的人民都能欣賞。1040811
